Alimony fund benefits are a form of support for people entitled to alimony whose enforcement has proven ineffective. Paid monthly by the municipality or social assistance center.

Who is the Alimony Fund for?

  • Children under 18 years of age (or 25 if studying)
  • Children with a significant disability certificate (no age limit)
  • Persons with ineffective alimony enforcement by a bailiff
  • Households meeting the income criterion

Ineffectiveness of enforcement must be confirmed by a court bailiff with a certificate covering the period of the last two months.

Key Questions

Does 800+ count as income?
No, 800+ is not included in the income calculation when determining eligibility for alimony fund benefits.
What if my income exceeds 1209 PLN?
Thanks to the 'zloty for zloty' rule, you can still receive the benefit, but it will be reduced by the amount of the threshold exceedance. Minimum payout is 100 PLN.
How long does the decision take?
The authority usually has 30 days to issue a decision from the moment a complete application is submitted.
Must a bailiff be conducting enforcement proceedings?
Yes. Proof of ineffective enforcement — a bailiff's certificate — is mandatory. Enforcement is considered ineffective when the full amount of ordered maintenance has not been collected for at least 2 months.
What consequences face the maintenance debtor?
The debtor is entered on the alimony debtor register. The authority may require them to take up employment or other activation activities and may apply for suspension of the debtor's driving licence.
